1. The Service

GuestVoice provides restaurants and hospitality venues with a QR code-based guest feedback system. The platform allows venue owners to collect private guest feedback, receive real-time alerts via Telegram and/or Whatsapp, and optionally direct guests to leave a public review on Google.

By activating your account, you confirm that you have read, understood, and agree to these terms. If you are accepting on behalf of a business, you confirm you have the authority to bind that business to this agreement.

2. Your Account

Access to the admin dashboard requires an email-based one-time-password login. You are responsible for maintaining the security of your email account credentials and must notify us immediately if you suspect unauthorised access. We are not liable for any loss resulting from unauthorised use of your account.

Each subscription covers one venue location. Additional locations require separate subscriptions unless otherwise agreed in writing.

3. Payment and Billing

The current standard subscription fee is €49 per month per location, billed monthly in advance. It covers up to 10 QR codes per locations. Bigger locations / more locations follow custom subscription pricing. Prices may change with 30 days' written notice.

Payment is due at the start of each billing period. Failure to pay within 7 days of the due date may result in suspension of the service. You may cancel at any time; cancellation takes effect at the end of the current billing period with no partial refunds for unused time.

4. Acceptable Use

You agree not to use GuestVoice in any way that violates applicable law, infringes the rights of third parties, or involves collecting data from minors without appropriate consent. You must not attempt to reverse-engineer, copy, or resell the platform without our written consent. You must not use GuestVoice in any way that selectively prevents or discourages guests from leaving public reviews based on the sentiment of their feedback.

5. Google Reviews — Your Responsibilities

GuestVoice's default configuration shows the option to leave a Google review to all guests, regardless of their rating. This is the recommended setting and is designed to comply with Google's Maps User Generated Content Policy.

Google's policy explicitly prohibits merchants from: “discouraging or prohibiting negative reviews, or selectively soliciting positive reviews from customers.” It requires that any solicitation of reviews reflects a genuine experience and does not attempt to influence the rating or content of the review.

GuestVoice shows the Google review option to every guest regardless of their rating. This is the only mode the platform operates in.

6. Data Ownership and Processing

Feedback data collected through your QR codes belongs to you. You are the data controller; GuestVoice acts as the data processor and processes this data only to provide the service described in these terms. Full details of data handling are set out in our Privacy Policy, which forms part of this agreement.

You are responsible for ensuring guests are informed that their feedback may be collected when they interact with your QR code, and for maintaining a lawful basis for that collection under applicable data protection law.

7. Service Availability

GuestVoice is provided "as is". We strive for high availability but do not guarantee uninterrupted service. We are not liable for temporary outages caused by third-party infrastructure providers (including Vercel, Supabase, or Telegram/Whatsapp). We reserve the right to modify or discontinue features with reasonable notice.

8. Limitation of Liability

GuestVoice does not guarantee that the service will achieve any particular outcome for your business, including improvements to your Google rating or review volume. To the maximum extent permitted by law, our total liability for any claim shall not exceed the total fees paid by you in the three months preceding the claim. We are not liable for any indirect, incidental, consequential, or special damages, including loss of revenue or reputational harm.

9. Termination

Either party may terminate this agreement at any time with written notice. Termination by you takes effect at the end of the current billing period. Termination by us for breach of these terms may take effect immediately. Upon termination, your data will be retained for 30 days and then permanently deleted. You may request an export before this period expires.

10. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by email or via a notice in your admin dashboard at least 14 days before the change takes effect. You will be asked to re-accept upon your next login. Continued use after acceptance constitutes agreement to the updated terms.

11. Governing Law

These terms are governed by the laws of Poland. Any disputes shall be subject to the jurisdiction of the courts of Poland, without prejudice to your rights as a consumer under the laws of your country of residence.
